These Terms of Service ("Terms") govern your use of the website operated by Toltech LLC ("Toltech," "we," "us," or "our") and the HVAC, refrigeration, and commercial kitchen equipment services we provide. By using our website or requesting services from us, you agree to these Terms. If you do not agree, please do not use our website or services.

1. About Toltech

Toltech LLC is a Nebraska limited liability company providing residential and commercial HVAC, commercial refrigeration, and commercial kitchen equipment services in Lincoln, Nebraska and surrounding areas. Our principal place of business is 501 South 50th Street, Lincoln, Nebraska.

2. Services

Toltech offers the following service categories:

• Residential and commercial HVAC service, repair, replacement, and new installation.
• Commercial refrigeration service, repair, replacement, and new installation.
• Commercial kitchen equipment service, repair, replacement, and installation.
• Annual residential and commercial maintenance agreements.
• 24-hour emergency service for HVAC and refrigeration emergencies.

Specific scope, pricing, and timelines for any work will be confirmed in writing (text, email, or invoice) before work begins, except in emergency situations where verbal authorization may be relied upon.

3. Quotes, Estimates, and Pricing

Estimates and quotes are based on information available at the time they are provided. Final pricing may differ if:

• Equipment, parts, or site conditions are different than represented or initially observed.
• Additional work is required and authorized by you during the job.
• Manufacturer pricing, parts availability, or labor requirements change.

You will be notified before any work that materially exceeds the original estimate is performed.

4. Payment Terms

Unless otherwise agreed in writing, payment is due upon completion of work. Toltech accepts payment by methods identified at the time of invoicing. Past-due balances may be subject to a late fee and may delay or suspend further service, including service under any maintenance agreement.

5. Maintenance Agreements

Annual maintenance agreements include scheduled summer and winter check-ups (or the commercial equivalent), discounted labor rates, and discounted parts pricing for covered equipment. Specific coverage is described in your individual agreement. Maintenance agreements do not cover:

• Replacement of major components or full systems.
• Damage caused by abuse, neglect, vandalism, or acts of nature.
• Equipment that has been modified or serviced by an unauthorized third party.

6. Warranties

Toltech warrants its labor on covered repair and installation work for the period stated on your invoice or written agreement. Manufacturer warranties on parts and equipment are governed by, and limited to, the terms of the manufacturer. Toltech will reasonably assist customers in filing manufacturer warranty claims.

EXCEPT AS EXPRESSLY STATED, ALL SERVICES AND PARTS ARE PROVIDED "AS IS" AND TOLTECH DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

To the fullest extent permitted by law, Toltech's total liability for any claim arising out of or related to our services or these Terms is limited to the amount you paid Toltech for the specific service giving rise to the claim. Toltech is not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost product, business interruption, or spoilage, except where prohibited by law.

You agree to:

• Provide safe, reasonable access to the equipment and work areas.
• Disclose known issues, prior repairs, or equipment modifications relevant to the work.
• Make timely decisions on parts, replacement, or scope changes when requested.
• Pay invoices on the agreed schedule.

10. Cancellations and Rescheduling

We understand schedules change. We ask for as much notice as possible when canceling or rescheduling a non-emergency appointment. Repeated late cancellations or no-shows may result in a trip charge or removal from the schedule.

11. Use of the Website

You may not use our website to:

• Engage in any unlawful activity or violate any applicable law or regulation.
• Attempt to gain unauthorized access to our systems or other users' data.
• Interfere with or disrupt the website's operation, security, or features.
• Submit false, misleading, or fraudulent information.

12. Intellectual Property

All website content — including text, graphics, logos, and design — is the property of Toltech LLC or its licensors and is protected by applicable intellectual property laws.
